What is a settlement agreement?
A settlement agreement (sometimes called a marital settlement agreement or property settlement agreement) is the document that records what you and your spouse have agreed about property, debts, and support. In an uncontested divorce it is one of the core documents filed with the court.
The agreement typically covers:
- Who keeps which assets
- Who is responsible for which debts
- Whether either spouse will pay spousal support
- How bank accounts, vehicles, and retirement accounts will be handled
When there are children, the parenting plan is usually a separate document, but the settlement agreement and the parenting plan work together as the full agreement the court reviews.
On DoUsPart, the settlement agreement language is built from attorney-reviewed templates. As you answer questions about the house, vehicles, accounts, and debts, you see previews of how those answers appear in the documents. You can go back and change an answer if the preview does not match what you and your spouse intended. The firm files the final documents.
A clear settlement agreement is one reason an uncontested divorce can move forward without a fight over property. If you cannot agree on how to divide the main assets and debts, the uncontested process will not fit.
