How does child custody work in an uncontested divorce?
Custody and parenting time are handled through a parenting plan. Both parents agree on where the children will live, how time is shared, and how major decisions will be made. The plan must be appropriate for the children and meet Montana requirements.
DoUsPart’s $1,900 fee includes the parenting plan documents along with the rest of the uncontested divorce. You will see previews of the parenting plan language as you answer questions. Once both spouses approve and sign, Scheveck & Salminen Law Firm, PLLC files the plan with the other divorce documents.
If you and your spouse cannot agree on custody or parenting time, an uncontested divorce will not resolve those issues.
If you are not married and only need a parenting plan, that is a different process. Visit DoUsParent. Montana courts also provide free parenting plan forms if you prefer to complete them yourself: Montana Courts – Parenting Plan forms.
