What if we have children?
If you have minor children, the divorce will include a parenting plan and child support. For many couples this is the most important part of the case. The parenting plan covers where the children will live, how parenting time is shared, and how major decisions will be made. Child support is calculated under Montana’s guidelines.
DoUsPart’s $1,900 fee includes the parenting plan documents along with the rest of the uncontested divorce. Both spouses still have to agree on the parenting terms. You will see previews of the parenting plan language as you answer the questions so you can confirm it matches what you and your spouse decided.
We do not represent you in a child support enforcement hearing. The service prepares the divorce and parenting plan documents and the firm files them. If a separate child support case or hearing is required later, that is outside this service.
If you are not married and only need a parenting plan, that is a different process. Visit DoUsParent for parenting plans for unmarried parents.
If you and your spouse cannot agree on custody or parenting time, an uncontested divorce will not resolve those issues. A different court process would be needed.
